Supreme Court Reinstates Senator Anyanwu as PDP National Secretary

The Supreme Court has overturned the judgments of both the Court of Appeal and the Federal High Court, which had removed Senator Samuel Anyanwu from his position as National Secretary of the People’s Democratic Party (PDP).

A five-member panel of the apex court ruled that determining the PDP’s National Secretary falls under the internal affairs of the party, making it non-justiciable.

Delivering the lead judgment, Justice Jamilu Tukur struck out the October 2024 ruling of the trial court and set aside the majority judgment of the Court of Appeal, which had upheld Anyanwu’s removal in December.

The Supreme Court instead affirmed the minority judgment of the appellate court, delivered by Justice Ekanem, which nullified the trial court’s decision on the grounds of lack of jurisdiction.

Furthermore, the court held that the plaintiff, Aniagu Emmanuel, lacked the legal standing to file the suit, as he failed to demonstrate how he was directly affected by the appointment of the PDP’s National Secretary.
