Former Speaker of the Lagos State House of Assembly, Mudashiru Obasa, has taken legal action against the Assembly and its new Speaker, Mojisola Meranda, challenging the validity of his impeachment.
Obasa filed the suit at the Lagos State High Court in Ikeja, arguing that his removal was unlawful since it occurred while the Assembly was on recess. The case, yet to be assigned to a judge, seeks a court declaration that his impeachment was illegal.
In the application dated February 12, 2025, and filed by his lawyer, Chief Afolabi Fashanu (SAN), Obasa claims he was ousted from office on January 13, 2025, by 36 lawmakers while he was outside the country.
The embattled lawmaker is requesting an accelerated hearing and an order shortening the defendants’ response time to seven days, with his own reply period limited to three days.
His challenge is based on constitutional provisions and the Lagos State House of Assembly’s Rules and Standing Orders. He argues that the Assembly’s proceedings during recess were unconstitutional, as the Speaker neither formally convened the House nor delegated such authority.
“Public interest necessitates that this case be heard and resolved quickly to avoid disruption of legislative activities in the state,” Obasa stated.
He insists that the court must urgently clarify the legality of the Assembly’s current leadership, as its actions allegedly violate established laws and procedures.
The case has not yet been scheduled for a hearing.
