Rivers State House of Assembly Flags Alleged Plots to Obtain Ex-Parte Court Orders Outside Port Harcourt

The Rivers State House of Assembly has raised concerns over alleged attempts by certain individuals to secure ex-parte court orders from High Courts outside the Port Harcourt Judicial Division, reportedly aimed at hindering the Assembly from executing its constitutional responsibilities.

In a statement signed by Hon. Dr. Enemi Alabo George DSSRS, Chairman of the House Committee on Information, Petitions and Complaints, the Assembly said it received credible intelligence regarding these purported plans.

The statement noted that the individuals involved are “fully aware” of the constitutional provisions, including Section 272(5), which vests the Federal High Court with jurisdiction over matters concerning the term of office of state House of Assembly members, governors, or deputy governors. It also cited Section 188(10), which prohibits courts from entertaining proceedings or decisions of the House of Assembly.

The Assembly highlighted recent judicial pronouncements, including a Court of Appeal ruling on a similar matter, which emphasised that ex-parte orders issued by certain High Courts were contrary to constitutional provisions.

Calling for restraint, Dr. George urged all concerned parties to respond directly to Notices of Allegations of Gross Misconduct rather than pursuing actions that could subvert the law or malign members of the Assembly through proxies or the media.
