US Judge Drops Three Charges in Trump Georgia Election Case

A Georgia judge on Thursday dismissed three charges from the indictment accusing former President Donald Trump and his co-defendants of attempting to overturn the 2020 election results in the state. Two of the dropped charges were directly related to Trump, leaving him facing eight felony counts in Georgia.

Fulton County Superior Court Judge Scott McAfee, while dismissing the three charges, declined to quash the entire indictment, which accuses Trump and his associates of racketeering and other offenses. The dismissed charges involved the submission of false elector certificates, claiming Trump had won Georgia, despite losing to Joe Biden by approximately 12,000 votes.

Judge McAfee ruled that the Supremacy Clause of the Constitution prevents state prosecutors from pursuing federal crimes, stating that federal law takes precedence over conflicting state law. Trump had been charged with filing false documents and conspiring to do so. However, due to an ongoing appeal to disqualify Fulton County District Attorney Fani Willis, the two charges related to false document filings will remain frozen until the Georgia Court of Appeals rules on the matter.

The indictment includes evidence, such as a phone call where Trump allegedly urged a Georgia election official to “find” enough votes to change the election outcome. Along with Trump, 18 co-defendants were indicted on racketeering and other charges, including former Trump lawyer Rudy Giuliani and ex-White House chief of staff Mark Meadows. Four of Trump’s co-defendants, including three former campaign lawyers, have already pleaded guilty to lesser charges.

In addition to the Georgia case, Trump was convicted in New York for falsifying business records in connection with a hush money payment and is also facing federal charges related to his alleged efforts to overturn the 2020 election, though no trial date has been set for the federal case.
