Supreme Court Ruling on ADC: No Grounds for Celebration, Nothing Concluded — Maduabuchi, SAN

Senior Advocate of Nigeria, Oba Maduabuchi, has said that the recent Supreme Court proceedings involving the All Democratic Congress (ADC) should not be seen as a final resolution of the party’s leadership dispute, insisting that “nothing has been decided.”

Maduabuchi argued that the ADC had no proper basis to approach the Supreme Court, stating that there was no valid appeal arising from the Federal High Court’s judgment. He maintained that the Court of Appeal exceeded its jurisdiction by issuing an order that was not requested by any of the parties.

He explained that although the Court of Appeal held that there was no competent appeal from the David Mark-led faction, it further directed that the status quo be maintained, which he described as procedurally incorrect.

According to him, the appellate court’s directive was intended to maintain the status quo ante bellum rather than a general status quo.

Maduabuchi further stated that the Independent National Electoral Commission acted within legal bounds when it relied on the Court of Appeal’s directive to take actions affecting the David Mark faction of the ADC.

He concluded that despite public interpretations of the rulings, the matter remains legally unsettled.
